4.6 You are responsible for all transactions made on the Site where Your PIN has been entered correctly.

4.7 It is Your responsibility to ensure that all Your personal details (including contact details) are current and up-to-date, accurate and not misleading and You agree to inform Us immediately if there is any change to such information.

4.8 If You lose any mobile device from which You are logged in to Your Account or on which Your login credentials are saved, You should first contact Your network operator to prevent it being used and then advise Us. 4.9 You are only permitted to open one Account for the Site. We will refuse to open an Account if You attempt to use a mobile phone number or email address already registered to another customer account for the Site. Your personal details supplied for Your Account will be confirmed through Our verification process. This is necessary to prevent abuse and/or fraud.

4.10 Your mobile network operator may charge You for using the Internet connection on Your phone and it is Your responsibility to meet such charges. Please check with Your operator if You are unsure which charges may be incurred by You.

5. ACCOUNT VERIFICATION

5.1 By agreeing to these General Terms and Conditions, You authorise Us to undertake such verification checks as may be required to satisfy Us:

(a) that You meet all of the eligibility requirements set out in section 4.1; and

(b) as to Your identity in order to enable Us to fulfil Our obligations under the Remote Gaming Licence under which We operate, including the detection and prevention of fraud, money laundering and terrorist financing,

(collectively, “Customer Checks“).

5.2 We reserve the right to ask You to provide documentary proof of eligibility and identity as part of the Customer Checks, at any time and will be carrying out regular checks. Failure to provide such proof or other reasonably requested information may result in the suspension of Your Account. We also reserve the right to conduct checks (including credit reference agency and other database checks) against any of the details provided to Us through any channels and methods available to Us. We reserve the right to submit Your personal information (as defined in Our Cookie Policy and Privacy Policy) to a third party for independent verification.

5.3 If the Customer Checks have not been completed within 72 hours from when You make Your first Deposit, or they have been completed within that timeframe but they do not satisfy Us as to Your eligibility and/or identity as set out in section 4.1, then (subject to section 7.12):

(a) Your Account will be suspended;

(b) You will not be allowed to place any further Wager(s); and

(c) We will pay over the then-current balance of Funds in Your Account (except where You do not satisfy Us that You are at least the Legal Age or that You are located in the United Kingdom, in which case We will instead return any Deposit that You have made and all Wagers placed by You will be void), always subject to section 5.3(d) below; and

(d) no Winnings (if any) shall be paid.

6. PROTECTION AND SEGREGATION OF YOUR FUNDS

6.1 We are required by Our Remote Gaming Licence to inform You about what happens to Funds which We hold in the event of Our insolvency: www.gamblingcommission.gov.uk/for-the-public/Your-rights/Protection-of-customer-funds.aspx

6.2 We hold Funds separate from Our company funds in a mixture of bank accounts. Funds are not protected in the event of Our insolvency. This meets the UK Gambling Commission’s requirements for the segregation of Funds at the level: basic segregation.

7. DEPOSITS AND WITHDRAWALS FROM ACCOUNT

7.1 You must deposit funds into Your Account by way of a Deposit before You can place any real money Wager, be eligible for any real money Winnings or be able to make a withdrawal from Your Account. You can only place any real money Wager up to the then-current balance of Funds in Your Account. You may be blocked from playing certain games (which may appear to be locked) and You will be not be eligible to play a jackpot or a progressive jackpot game until You make a Deposit. Any Wagers placed using Bonus funds shall be subject the applicable Promotional Terms and Conditions and section 8 below.

7.2 You can make a Deposit by accessing the 'Account Services' facility of the Site or by using the “deposit“ button wherever it is available on the Site. You can use any of the payment methods listed on the Site from time to time. The ‘Help’ section of the Site contains further information about these methods. You confirm to Us that You are authorised to use the payment method You choose to use when depositing into Your Account.

7.3 There are minimum and maximum limits on the amounts that You can deposit in Your Account, which are as follows: each separate Deposit must be at least ten pounds sterling (£10(GBP)) and no greater than one thousand pounds sterling (£1,000 (GBP)). You are not permitted to make more than forty (40) Deposits in any one calendar day (UK time).

7.4 In the event that You make a Deposit using a credit or debit card and the provider of that card 'claws back' any or all of the amount deposited (for any reason, including without limitation, a disputed transaction or suspected fraud), We will be entitled to deduct the amount 'clawed back' from Your Account, but will notify You of the fact and the amount involved if We do so.

7.5 All financial Winnings will be credited to Your Account. You are solely responsible for the payment of any applicable tax(es) in relation to Your receipt of any Winnings.

7.6 The balance of Funds on Your Account will not entitle You to any interest.

7.7 If You become aware that any amount has been incorrectly credited into Your Account, You must notify Us immediately and We are entitled to reverse such credited amount (including but not limited to Bonuses) from Your Account or require You to repay it to Us immediately if You have already withdrawn it. If You use any incorrectly credited amount to place any Wager, We are entitled to declare such Wager void and reverse any resulting Winnings from Your Account or require You to repay them to Us immediately if You have already withdrawn them.

7.8 You can make a withdrawal, up to the then-current balance of Funds in Your Account, by accessing the 'Account Services' facility of the Site. You can use any of the withdrawal methods listed on the Site from time to time. The ‘Help’ section of the Site contains further information about these methods. You may not make a withdrawal until our Customer Checks have been completed, in accordance with section 5 above.

7.9 There are minimum and maximum limits on the amounts that You can withdraw from Your Account, which are as follows:

(a) Withdrawal by credit or debit card: Except in the case of a final withdrawal on termination of Your Account, the minimum withdrawal amount is ten pounds sterling (£10 (GBP)) and the maximum withdrawal amount is twenty thousand pounds sterling (£20,000 (GBP)). Withdrawals by this method are limited to five (5) per calendar day (UK time).Withdrawal requests to a credit or debit card can only be made to a card in Your name registered to Your Account and with which You have previously made a Deposit.

(b) Withdrawal by PayPal: Except in the case of a final withdrawal on termination of Your Account, the minimum withdrawal amount is ten pounds sterling (£10 (GBP)) and the maximum withdrawal amount is one thousand pounds sterling (£1,000 (GBP)). Withdrawals by this method are limited to one (1) per calendar day (UK time). Withdrawal requests via PayPal can only be made to the PayPal account in Your name registered to Your Account and with which You have previously made a Deposit.

7.10 Although We endeavour to assist all customers regarding their withdrawals, We will not be held liable for any losses that may be incurred where a withdrawal from Your Account has been successfully processed by Our bank to Your chosen payment method in accordance with the information that You have provided to Us.

7.11 It is Your responsibility to ensure that the details of any credit or debit card, bank account or PayPal account registered to Your Account are current and up-to-date, and You agree to inform Us immediately if there is any change to such information. Failure to do so may jeopardise Your ability to make Deposits or withdraw Funds from Your Account.

7.12 We have the right (without limiting any of Our rights under these General Terms and Conditions or otherwise), at any time, to withhold all or part of the then-current balance of Funds in Your Account where We are required by law to do so and/or to deduct from that balance: (a) any amount which We are required by law to deduct; and/or (b) any amount which We are otherwise required or permitted by these General Terms and Conditions to deduct. If following Our attempt to pay over any balance to You such balance is returned to Us because the details of any credit or debit card, bank account or PayPal account registered to Your Account are not up-to-date and otherwise accurate (for example, the account has been closed), We will be entitled to donate such balance to a UK-registered charity of Our choice.

8. BONUS FUNDS AND VIP CLUB

8.1 We may credit to Your Account Bonus funds from time to time, in accordance with the applicable Promotional Terms and Conditions. If any Bonus funds are credited to Your Account by Us, any Wagers You place will be made using any real money Funds available in Your Account before any Bonus funds are used and if You have any Free Bonus funds in Your Account, such Free Bonus funds will be used before any other Bonus. If You request a withdrawal before the withdrawal requirements in respect of any Bonus funds set out in this section are satisfied, such Bonus funds and any Winnings resulting from the use of such Bonus funds will be forfeited. Bonus funds may also be combined with real money Funds to place a Wager which exceeds the balance of the real money Funds in Your Account at the time. Winnings from such Wagers will be paid in Bonus funds and real money in the proportions of Bonus and real money funds used to place such Wager.

8.2 All Bonus funds are subject to a wagering or 'play through' requirement, set out in the applicable Promotional Terms and Conditions, before such Bonus funds become eligible for withdrawal. By way of an example, if Your Account is credited with a Bonus of £1.00 (GBP) with a wagering requirement of “fifty times“, this means that You will have to Wager £50.00 (GBP) before being able to withdraw such Bonus funds and any Winnings resulting from Wagers placed using such Bonus funds.

8.3 You can check the balance of Your Funds, Bonuses and the status of any wagering requirements at any time in the Account Service menu or by contacting our customer service team. The amount of Bonus funds in Your Account and associated wagering requirements are also available in the “balance“ section of the menu of any game.

8.4 In addition to any applicable Promotional Terms and Conditions, the following principles apply to the calculation of wagering requirements on specific games:

(a) In roulette games, ONLY Wagers placed with Bonus funds on inside bets reduce the wagering requirement in respect of such Bonus funds, at a ratio of 10:1. That is, every £1.00 (GBP) wagered reduces the wagering requirement by £0.10 (GBP). The maximum reduction in the wagering requirement for a single roulette spin is £10.00 (GBP) when wagering with Bonus funds. Wagering with Bonus funds on outside bets DOES NOT reduce wagering requirement. Wagers on table number bets which cover MORE THAN eighty percent of table (31 numbers) also do not reduce the wagering requirements.

(b) For blackjack games, all Wagers placed on discrete bets using Bonus funds reduce the wagering requirement in respect of such Bonus funds at a ratio of 10:1. That is every £1.00 (GBP) wagered reduces the wagering requirement by £0.10 (GBP). This applies “per hand“, with includes SPLITS, DOUBLES and INSURANCE as separate Wagers.

(c) Each Wager equal to £1.00 (GBP) placed using Bonus funds on the following games reduces the wagering requirement in respect of such Bonus funds by fifty pence (£0.50): Super Fruity, Pirates of Chance, Oceans Hoard, Money Miner, The Slot and Reindeer Readies, Moving Moments & Fizz Factory.

(d) On all other games, each Wager equal to £1.00 (GBP) placed using Bonus funds reduces the wagering requirement in respect of the such Bonus by £1.00 (GBP).

(e) A single Wager on any game placed using Bonus funds (irrespective of the size of the Wager) can reduce the wagering requirement in respect of such Bonus funds by a maximum of £10.00 (GBP).

8.5 You may not use any Bonus funds to place Wagers on any jackpot game (including any progressive jackpot game) and any Winnings resulting from any Wager placed using Bonus funds will be credited to Your Account as Bonus funds, and will not be eligible for withdrawal until the wagering requirement is satisfied in respect of such Bonus funds.

8.6 You may place Wagers using Free Bonus funds, however You will only be eligible to withdraw a maximum total of £50.00 (GBP) of any Winnings resulting from Wagers placed using any Free Bonus, and only once the wagering requirement in respect of such Free Bonus is satisfied.

8.7 Any unused Bonus funds may be cancelled by Us after ninety (90) days with no further liability to You.

8.8 You may receive any welcome Bonus and be eligible for any promotion involving new customers only once. When such promotional offers are related to Your Deposits only a single Deposit transaction will be eligible.

8.9 You may not be eligible to be awarded more than three Bonuses related to Your Deposits in a 24-hour period calculated from midnight to midnight (UK time).

8.10 You may be placed in Our VIP club at Our sole discretion. We reserve the right to refuse or revoke VIP membership at any time and VIP status will be removed if the minimum Deposit requirements are not met within an eight (8) week period.

8.11 Our VIP programme has different levels and the privileges and benefits of the programme are dependent on player activity within a period of time. You may find that Your benefits increase and decrease according to the level You attain within the programme.

9. TERMINATION OF YOUR ACCOUNT BY YOU

9.2 We will respond, as soon as reasonably possible, to Your request confirming termination of Your Account and the date when such termination will be effective.

We will do so using the same method of payment You provided upon registration of Your Account, or such other payment method as We may reasonably select.

10. TERMINATION OR SUSPENSION OF ACCOUNT BY US

10.1 We are, at any time and for any reason, entitled to terminate Your Account and end Your entitlement to access and use the Site and Services. If We do this then We will notify You using the contact details You provided upon registration of Your Account.

10.2 We shall be specifically entitled to terminate or suspend Your Account and Your entitlement to access and use the Site and Services at any time with immediate effect if any of the following has occurred (or We have reasonable grounds to believe that any of the following has occurred):

(a) any actual or attempted illegal or dishonest activity (as described in section 13) by You;

(b) breach of these General Terms and Conditions by You (including any of the eligibility criteria set out in section 4.1), in which case any Winnings arising in connection with such breach will not be paid out;

(c) breach of any applicable laws or regulations by You in connection with the Site, Services and/or Your Account;

(d) You take an unfair advantage. This shall include, without limitation, cheating, taking advantage or exploitation by You of any technical fault or loop hole on the Site or of an error on Our part or use of any third party’s software (including, but not limited to “bots'', Al software and other software used for opponent-profiling, automatic betting etc.), any form of malware (including, but not limited to, viruses, worms, trojan horses and spyware) or other code that may be deemed malicious used by You in relation to the Services; and/or

(e) You cause to be published on, and/or send via, the Site any actual or potentially defamatory, offensive or obscene content.

10.3 In the event of termination or suspension by Us under sections 10.1 or 10.2, We will notify You using the contact details You provided upon registration of Your Account.

10.4 In the event of termination by Us under sections 10.1 or 10.2, We will, as soon as reasonably possible, pay over the then-current balance of Funds in Your Account to You using the same method of payment You provided upon registration of Your Account, or such other payment method as We may reasonably select, but subject always to section 7.12.

10.5 If any of the circumstances set out in sections 10.2 has occurred (or We have reasonable grounds to believe that any of them has occurred), We shall be entitled to pass Your details to the UK Gambling Commission and other applicable law enforcement authorities.

10.6 The rights set out in this section 10 are without prejudice to any other rights that We may have against You under these General Terms and Conditions or otherwise.

11. DORMANT ACCOUNTS

11.1 If You do not use Your Account for more than six (6) months, We will consider it to be dormant.

11.2 Should Your Account become dormant, We will, after a further six (6) months make reasonable efforts to contact You if You have Funds in Your Account. This contact may be via telephone, SMS, email and/or via post using the contact details registered in Your Account. If You do not respond to Our attempt(s) to contact You within twenty-eight (28) days, then We reserve the right to terminate or suspend Your Account. We will send a communication to Your last known postal address (as registered on Your Account) if We do this.

11.3 In the event of termination by Us under section 11.2, We will, as soon as reasonably possible, pay over the then-current balance of Funds in Your Account to You using the same method of payment You provided upon registration of Your Account, or such other payment method as We may reasonably select, but always subject to section 7.12.

12. GAME RULES

12.1 The game-specific rules, odds and expected return to players of each game (collectively, “Game Rules“) are available in the menu of the game itself. Expected return is a statistical average and the actual return You experience may vary significantly with each Wager. All of Our games and Our random number generator are independently audited for fairness and accuracy.

12.2 The minimum and maximum Wager on each game are set out in the relevant Game Rules.

12.3 The placing of Wagers, playing of games and notification of the outcome of games relies upon the internet connection between the device which You use to access the Site and Our servers. You should be aware that if Your internet connection is interrupted or fails before Your Wager is registered on Our gambling servers the Wager will not have been placed (in which case the Wager will not be deducted from Your Account) or, if the connection is interrupted or fails during game play, the game will continue and the outcome will not be effected, or, if the connection is interrupted or fails whilst We are notifying You of the outcome, the outcome will not be effected. Winnings (if any) will be paid into Your Account, regardless of whether You have seen the outcome.

12.4 In the event of a malfunction or a defect in Our gambling servers or other related systems (including Our software or any third party software) that adversely effects the placing of any Wager and/or the playing or an outcome of any game, all affected Wagers and Winnings will be void. In such circumstances, We will notify You and any affected Wager placed by You will be returned and You will need to return to Us any Winnings resulting in connection with any affected Wagers.

12.5 The official outcome of all Wagers placed is available either in the relevant game itself or, if Your internet connection is interrupted or fails during game play, You should Contact Us. Our transaction records shall be the final authority in determining the timing and amount of Wagers placed and the outcome of games played.

12.6 For a full printed statement of Your Wagers and Winnings, please Contact Us.

12.7 If You win 'free spins' or other bonus game play (collectively, “Extra Game Play“) in a game session then please ensure that all Extra Game Play is all used in that same game session. If Your game session is interrupted before You have used all of the Extra Game Play (for example if the battery on Your device runs out of power) then We cannot guarantee that You can resume that same game session and use the remaining Extra Game Play. If that does happen then We advise that You access Your Account from the same device that You used for the interrupted game session within 90 days on the basis that You might be able to resume that same game session and recover the remaining Extra Game Play, however resumption of the game session cannot be guaranteed and, in the event the gaming session is cancelled for any reason, Your Wager will be refunded or, if the outcome of the game play is already known, the result will be reflected on Your Account. We will not be responsible for Your loss of the remaining Extra Game Play.

13. ILLEGAL AND DISHONEST ACTIVITY

13.1 Any form of illegal or dishonest activity is strictly prohibited. For the purposes of these General Terms and Conditions, this may include, but is not limited to, using a stolen credit or debit card or other fraudulent activity, forgery, collusion, cheating, bribery, money laundering and the provision by You to Us of false registration data or other requested information. If You are found to have participated in any such activity (or We have reasonable grounds to believe You have), Your Account may be terminated or suspended in accordance with section 10.2 and/or legal proceedings may be brought against You.

14. LIMITATION OF LIABILITY

14.1 We will provide the Services with reasonable care and skill and in accordance with these General Terms and Conditions. We do not make any other promises regarding the Services and/or Your Account. In particular, We do not promise that the Site or Services will have uninterrupted availability or that it will be free of bugs or other errors.

14.2 Nothing in these General Terms and Conditions shall limit or exclude Our liability to You:

(a) for death or personal injury caused by Our negligence;

(b) for fraudulent misrepresentation;

(c) for breach of any term implied by the Consumer Rights Act 2015 and which, by law, may not be limited or excluded; or

(d) for any other liability that, by law, may not be limited or excluded. Subject to this, in no event shall We be liable to You for any business losses, and any liability We do have for losses You suffer is strictly limited to losses that were reasonably foreseeable and shall not exceed the total sum of one million pounds sterling (£1,000,000 (GBP)) in aggregate.

14.3 We shall not be liable for any failure to perform, or delay in performance of, any of Our obligations, including, without limitation, any delays or disruption to the Services, due to any reason outside Our control.

15. YOUR SECURITY

15.1 To ensure that Your credit, debit or charge card is not being used without Your consent, We and/or Our payment services providers will validate name, address and other personal information supplied by You during the registration and /or any other process against appropriate third party databases. These checks will not normally appear on Your credit record or be known to anyone other than the third party company We use to make these checks. Sometimes We are required to make checks against official records in order to comply with anti-money laundering and anti-terrorism legislation. Such checks may appear on Your credit record. All information provided by You will be treated securely and strictly in accordance with the relevant data protection legislation and Our Cookie Policy and Privacy Policy.

It is Your responsibility to inform Us of any changes to Your email address and other contact details.

16.2 When making a complaint, please provide details of Your identity and any relevant details that gave rise to the complaint. Please help Us by including the full URL on the Site to which Your complaint relates in the “Subject“ field to ensure that Your e-mail reaches the relevant team as quickly as possible.

16.3 Our customer services team (please find the relevant contact details on the Contact Us section of the Site) will deal with Your complaint and where necessary escalate it within Our customer services team until resolution. We will endeavour to deal with Your complaint within 7 days, depending on the nature and complexity of Your complaint.

16.4 If You are still unhappy with the solution offered by Us, then You may escalate Your query/complaint to be determined by the Independent Betting Adjudication Service Limited (IBAS), whose ruling shall be binding. IBAS rules on complaints about betting and gaming transactions, but does not deal with service-related problems. We are required to inform You that IBAS is an alternative dispute resolution body to whom We are obliged, by law, to refer any dispute that cannot be resolved between You and Us.

16.5 The European Online Dispute Resolution platform http://ec.europa.eu/consumers/odr/ provides information about alternative dispute resolution which may be of interest and We are required to inform You that You may use it if there is a dispute that cannot be resolved between You and Us.

17. MISCELLANEOUS

17.1 If any part of these General Terms and Conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from the remainder of these General Terms and Conditions, which will continue to be valid and enforceable to the fullest extent permitted by law.

17.2 These General Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and You agree that any dispute between You and Us regarding them, any Services and/or Your Account will only be dealt with by the English courts, provided that, if You live in a part of the United Kingdom other than England, the applicable law of that part of the United Kingdom will govern and any dispute will only be dealt with by the courts there.
